Alimony investigation by Haagsch Recherchebureau

You're divorced and you're paying alimony to your ex. Or maybe you are in the process of divorce and your former partner wants to receive alimony from you? How do you decide whether you do not (anymore) have to pay this alimony and how is this investigated by a private investigation agency? You can read it in this blog.

Article 1:160 of the Dutch Civil Code

Starting a Alimony research has everything to do with Article 1:160 of the Dutch Civil Code. The legal description consists of the following: “An obligation on the part of a former spouse to provide maintenance to the other party as a result of divorce ends when the other party remarries, enters into a registered partnership or has started living with another person as if they were married or had registered their partnership.” This article therefore determines or determines when the payment of alimony will cease to exist. Often, former partners do not register their partnership, do not enter into marriage or enter into a registered partnership, as they will lose the right to maintenance.

If you have paid attention, there is only one option left: living with someone else, they were married. This requires proof in 5 areas. You can read which ones these are later, but first the following. Each of the 5 points can be demonstrated in different ways. We deliberately do not share what these ways are in this blog. After all, we don't want to help former partners.

1. Having an affective relationship

As a private investigator, we must demonstrate that there is an affective relationship. There are many ways to express this.

2. Sustainable nature

In addition to being an affective relationship, it must also be a relationship of a sustainable nature.

3. Mutual care

Point 3, mutual care, is often the most difficult of the 5, after all, much of it takes place indoors, which we, as private researchers, are not (allowed) to have any insight into.

4. Living together

Through images, we can demonstrate living together. Good to know is that living together does not have to be in one place. Alternating living together in 2 places is therefore also living together.

5. Maintaining a common household.

The last point, number 5, to further increase the chances of success. When running a communal household, we look at whether costs are shared and whether they share the household. Unfortunately, we can't go too deep into this, so as not to make your ex any wiser, among other things.

Deployment of a Lawyer

We always recommend that our clients hire a lawyer. Especially when it comes to this type of investigation, we also often work with this lawyer. In this way, together we increase the success rate of your business and tackle spousal maintenance fraud on.

Free advice?

We are happy to advise you without obligation and completely free of charge, after all, every case is different. We can well imagine that you find it exciting to hire a detective agency, after all, you don't do that every day. An informal one consultation therefore, if necessary, takes place on neutral ground and the contact takes place via your preferred channel. This so that the other party does not get any of the contact you have with us. For example, we can be reached via WhatsApp, phone, email and in person.
